Welcome to DEEOW. The terms "we", "us" and "our" refer to DEEOW, a brand operated by HONG DAO FA INTERNATIONAL LIMITED (鴻道發國際有限公司). DEEOW operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). DEEOW is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (the "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about orders, product use, warranty disclaimers, limitations of liability and other legal rights.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province or jurisdiction of residence, or that you have the legal capacity required to use the Services and enter into transactions with us.

To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing information, payment information and shipping information. You represent that the information you provide is accurate, current and complete and that you have the right to provide it.

If you create an account, you are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to display product colors, dimensions, materials, features and other product information accurately. Actual colors may vary slightly depending on your device, screen settings or lighting conditions.

Product descriptions, pricing, availability and features may be updated from time to time. We reserve the right to modify or discontinue products and to limit quantities or availability by person, geographic region or jurisdiction, subject to applicable law.

Product Fit and Safe Use

Pet toys should be selected based on your dog's size, mouth size, chewing style, play habits and the product's recommended fit. No pet toy is indestructible. Use products only for their intended play purpose, provide appropriate supervision, inspect toys regularly, and discontinue use if a toy becomes damaged, loose, torn or otherwise unsafe. SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. DEEOW reserves the right to accept, decline, limit or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing or listing errors, inventory issues, incomplete information, payment issues or other circumstances that may prevent us from fulfilling the order.

Your order is accepted when we confirm acceptance and successfully process the applicable payment. Please review your order carefully before submitting it. Cancellation or modification requests are not guaranteed once an order has entered processing or has shipped.

If we cancel an order after payment has been processed, the applicable amount paid for the canceled item or order will be refunded to the original payment method.

Returns, replacements and refunds are handled solely in accordance with our Returns and Refunds Policy. DEEOW does not accept physical returns for orders placed through deeowpet.com. Eligible order or product issues are reviewed through our customer support process and, where approved, are generally resolved by replacement in accordance with that policy.

Unless otherwise agreed in writing, purchases made through our consumer store are intended for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged for a product will be the price displayed at the time the order is placed and will be reflected in your order confirmation.

Unless otherwise stated, product prices do not include applicable sales tax or shipping charges. Where DEEOW is registered and required by applicable law to collect U.S. sales tax, the applicable tax will be calculated based on the order and shipping destination and displayed at checkout before you complete your purchase. Sales tax rates and collection obligations may change based on applicable state and local law and DEEOW's tax registrations.

Prices and promotions offered on deeowpet.com may differ from prices or promotions offered through third-party retailers or marketplaces.

You agree to provide current, complete and accurate purchase, payment and account information for transactions with us. You represent that you are authorized to use the payment method submitted and agree to pay all charges associated with your accepted order.

SECTION 5 - SHIPPING AND DELIVERY

We make commercially reasonable efforts to process and ship orders according to our published Shipping Policy. Delivery times are estimates only and are not guaranteed.

Delays may occur due to carriers, weather, local delivery conditions, high shipping volume, operational disruptions or other circumstances outside our reasonable control.

Shipping rates, tracking, address changes, delayed shipments, lost or missing packages, packages marked delivered, damaged shipments and undeliverable or returned packages are handled in accordance with our Shipping Policy.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including trademarks, brand names, logos, text, product copy, images, graphics, video, audio, product reviews, layouts and other content, are owned by DEEOW, its affiliates or licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only. Unless we give prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit material from the Services except as permitted by applicable law.

DEEOW names, logos, product names, service names, designs and slogans are trademarks or protected brand assets of DEEOW, its affiliates or licensors. Shopify names and marks belong to Shopify. Other names and marks belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may provide access to tools or functionality offered by third parties that we do not control or monitor. Such tools are provided on an "as is" and "as available" basis, without endorsement or warranties from us, to the fullest extent permitted by law.

Your use of third-party tools is at your own discretion and may be subject to the third party's separate terms and privacy policies.

Future tools, features or resources made available through the Services will also be subject to these Terms unless otherwise stated.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain links, embedded features or materials provided by third parties. We are not responsible for examining or evaluating the content, accuracy, privacy, security or practices of third-party websites or services that you choose to access.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

DEEOW is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with DEEOW. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and DEEOW, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with DEEOW.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy. Certain information may also be processed by Shopify in accordance with Shopify's applicable privacy notices.

Because the Services are hosted by Shopify, information you submit may be transmitted to and processed by Shopify and service providers in other countries where necessary to provide and improve the Services. SECTION 11 - FEEDBACK

If you submit, upload, post, email or otherwise provide ideas, suggestions, feedback, reviews, proposals, photos, videos or other content (collectively, "Feedback"), you grant DEEOW a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, modify, publish, distribute, display and otherwise use that Feedback for operating, improving and promoting the Services, subject to applicable law and our Privacy Policy.

You represent that you own or have the rights needed to provide the Feedback, that you have disclosed any compensation or incentives associated with it where required, and that the Feedback does not violate law, third-party rights or these Terms.

We may, but are not required to, monitor, edit or remove Feedback that we reasonably believe is unlawful, misleading, abusive, obscene, infringing or otherwise inappropriate. You remain responsible for the Feedback you submit and its accuracy.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, estimated transit times, availability or other information.

We may correct errors, update information, change or cancel affected orders where reasonably necessary. If we cancel an order after payment has been processed because of such an error, we will refund the applicable amount paid for the canceled item or order.

SECTION 13 - PROHIBITED USES

You may access and use the Services only for lawful purposes. You may not use the Services to violate law, infringe intellectual property or privacy rights, harass or harm others, transmit false or misleading information, distribute malware, spam or unauthorized promotional material, impersonate another person or entity, or interfere with the security or operation of the Services.

You also agree not to reproduce, duplicate, copy, extract, sell, resell or exploit portions of the Services; collect or track personal information of others without authorization; use scraping, data gathering or automated tools to access the Services except as expressly permitted under Section 14; or bypass security, authorization, robot exclusion or access-control measures.

We may suspend, restrict or terminate access to the Services if we reasonably determine that these Terms have been violated.

SECTION 14 - AGENTS

14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

14.2 No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in Section 14.4 below. In addition, no Agent may access, use, or interact with the Services if we have requested that the Agent refrain from doing so.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.

14.4 Agents must: (i) identify that a request is from an Agent and disclose the Agent name in the request user-agent string using a format such as "Agent/[agent name]"; (ii) not conceal or obfuscate that access or interactions are from an Agent, including by mimicking human behavior or circumventing CAPTCHAs or similar measures; (iii) respond truthfully to questions intended to determine whether interactions are from a human or computer; and (iv) not circumvent measures intended to block, limit, modify, or control Agent access to the Services.

SECTION 15 - TERMINATION

We may suspend or terminate your access to the Services if you materially violate these Terms, misuse the Services, or where suspension or termination is otherwise reasonably necessary to protect DEEOW, Shopify, other users or the Services.

Termination does not affect amounts already due or provisions that by their nature should continue after termination, including provisions relating to intellectual property, feedback, disclaimers, limitation of liability, indemnification, severability, governing law and privacy.

SECTION 16 - WARRANTIES AND DISCLAIMER

We make reasonable efforts to keep the Services and product information accurate and current, but we do not guarantee that the Services will always be uninterrupted, timely, secure or error-free.

DEEOW does not provide an additional voluntary written product warranty unless a specific warranty is expressly provided for a particular product. Product-specific descriptions, commitments, and any published warranty terms remain subject to their stated terms and applicable law. Our 30-Day Support Window under the Returns and Refunds Policy is a customer-support process for eligible order and product issues and is not a guarantee of product lifespan or resistance to normal wear, chewing, tearing, puncturing or other play-related damage.

To the fullest extent permitted by applicable law, and except for any express product-specific commitments or warranties that apply, we do not make additional warranties regarding the Services. Nothing in these Terms excludes or limits any statutory warranty, implied warranty, consumer protection right, or other right that cannot lawfully be excluded or waived.

SECTION 17 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, DEEOW and our affiliates, directors, officers, employees, agents, contractors, licensors and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost revenue, lost savings or loss of data, arising from or related to your use of the Services or products purchased through the Services.

Nothing in these Terms excludes or limits liability to the extent that such liability cannot lawfully be excluded or limited, including any non-waivable consumer protection rights under applicable law.

SECTION 18 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless DEEOW, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors and service providers from third-party claims, losses, liabilities and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of a third party's rights.

We will provide reasonable notice of an indemnifiable claim where practicable. You agree to reasonably cooperate in the defense of such a claim.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary, and the remaining provisions will continue in effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies and operating rules referenced on the Services, constitute the agreement between you and DEEOW regarding use of the Services and supersede prior or contemporaneous communications relating to the same subject matter.

SECTION 21 - ASSIGNMENT

You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent. We may transfer or assign these Terms and our rights and obligations in connection with a merger, reorganization, sale of business or assets, corporate restructuring, or as otherwise permitted by law.

SECTION 22 - GOVERNING LAW

These Terms and any separate agreements through which we provide the Services are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without giving effect to conflict-of-law principles.

Nothing in this section limits any mandatory consumer protection rights that apply to you under applicable law and cannot lawfully be excluded or waived. Subject to such mandatory rights, you and DEEOW submit to the non-exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

SECTION 24 - CHANGES TO TERMS OF SERVICE

You may review the current version of these Terms on this page at any time.

We may update, change or replace portions of these Terms by posting an updated version on our website. Where required by applicable law, we will provide notice of material changes. Continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.
